Privacy notice – Super member contributions statements

Member contributions statement instructions privacy notice.

We are authorised by the Taxation Administration Act 1953 to collect the information in the member contributions statement (MCS), including the super fund and member tax file numbers (TFNs). We will use the TFN to identify the member in our records.

It is not an offence for a member not to provide their TFN to a super fund however there are consequences if they don't, including:

  • the super fund will pay additional tax on employer contributions and other assessable contributions made for the member
  • the super fund cannot accept member contributions, including super co-contributions, low income super contributions and low income superannuation tax offset.

Where a member TFN is not provided there may be delays or administrative errors in processing this statement.

The super fund is required to report a member TFN in the MCS under section 390-5 of Schedule 1 of the Taxation Administration Act 1953. We are also authorised under the Taxation Administration Act 1953 to ask for the information in this statement, including the details of members, their contributions and the attributes of their superannuation accounts.

We need this information to help us administer the following super and tax laws:

  • Superannuation (Excess Concessional Contributions Tax) Act 2007
  • Superannuation (Excess Non-concessional Contributions Tax) Act 2007
  • Superannuation (Excess Untaxed Roll-over Amounts Tax) Act 2007
  • Superannuation Contributions Tax (Assessment and Collection) Act 1997
  • Superannuation Guarantee (Administration) Act 1992
  • Superannuation Industry (Supervision) Act 1993
  • Superannuation (Government Co-contribution for Low Income Earners) Act 2003
  • Superannuation (Unclaimed Money and Lost Members) Act 1999.

Where authorised by law, we may give this information to other government departments and agencies, including:

  • Department of Education
  • Department of Employment
  • Department of Social Services
  • Services Australia
  • Department of Home Affairs
  • State and Federal Police
  • Australian Securities & Investment Commission
  • Australian Prudential Regulation Authority
  • Australian Bureau of Statistics
  • Reserve Bank of Australia.

As the person authorised to complete this form, we collect some personal information about you. That information will allow us to contact you if we need to know more.

We may give your employer name and other information in the MCS to the individual or member.

We also provide taxpayer information to treaty partners overseas under international tax agreements.

If you have an Australian Business Number, some information on this form may be collected under the A New Tax System (Australian Business Number Act) 1999 and will be used to update your details on the Australian Business Register (ABR). Where authorised by law, selected information may be made publicly available and some may be passed to a wide range of government agencies, including Commonwealth, state and local government agencies.
