7. Round table discussion

The following item were raised:

  • A member expressed his appreciation of the ATO supporting amendments so that beneficiaries of trusts carrying on a primary production business can continue to use the primary production averaging and farm management deposit provisions in a year in which the trust makes a loss.

The Commissioner reiterated the use of the Tax Issue Entry System (TIES) that is an Australian Government initiative jointly managed by the ATO and the Department of the Treasury. TIES provides an opportunity for you to raise issues relating to the care and maintenance of the Australian Government's tax and superannuation systems.

Care and maintenance issues are about making sure the existing law operates in the way it was intended, by correcting technical or drafting defects, removing anomalies and addressing unintended outcomes. These could involve minor policy changes, though they typically would not have a significant revenue impact.

If you are not sure if your issue is a care and maintenance issue, you are encouraged to submit it and you will be advised if it can be dealt with through TIES.

  • An out of session response to an issue raised at a previous meeting about the provision of notices of assessment in an electronic format lead to a discussion about the appropriate mechanism for delivery. A key consideration in the design is the legal standing of an electronic delivery of a notice of assessment.
  • Further to an earlier discussion in relation to improvements to the functionality of the Tax Agent Portal, a member raised a query about the inability to prepare, print and save (but not lodge) a client's BAS/IAS return. The member provided an example of a client with a Deferred GST amount.

    James O'Halloran advised that the matter would be raised with Alison Lendon, First Assistant Commissioner, Business Solutions for possible discussion at a future meeting as per action item CSBCG 2011/06-04.

During the course of the meeting there was a video presentation of 100 People.

The purpose of the '100 People' concept is to provide an easy-to-understand and entertaining insight into the taxation system, using statistics from Taxation statistics 2008-09 and other tax data for that financial year to create a representation of the community as if it was just one hundred people.

In a media release issued on 27 May 2011 the Commissioner stated '100 People' is a good way for people to get a greater appreciation of how our community is represented in our tax system and also allows people to see how their personal circumstances fit in with everyone else's.'
