5. Other business - any fuel tax credit issues

Andrew invited the forum members to raise any potential issues they had which they wanted to discuss. He advised that the Tax Office has probably covered off regarding general issues from our side but members may have something specific to discuss.

Julie advised that they want to be kept in the loop regarding CPRS.

Andrew advised that the Tax Office cannot provide any information until the legislation has been passed but once any information is available the Tax Office would engage with forum members.

NSW Emergency Service forwarded letter in March 2009 to the Attorney General requesting that they look at extending the eligibility of emergency vehicle regardless of the weight. They have had no response from the minister.

Andrew McIver explained the distinction between the Tax Office as administrator of enacted legislation and Treasury as the policy agency. Policy issues are forwarded to Treasury.

Brian McKay advised that he will follow this up and get back to them regarding the progress.

Darryl Daisley provided feedback regarding private ruling complex issue in the mining industry. He advised that he doesn't believe that the Tax Office know the industry particularly well. He hasn't noticed tax officers going out to mines and seeing what activities claimants undertake. He provided an example of beneficiation of Liquified Natural Gas (LNG). Queries that come back show that the person(s) dealing with the requests have little or no industry knowledge.

Andrew advised that he couldn't comment on the level of experience (in relation to that particular area), but stressed that we need time to build a high level of expertise.

Darryl advised that they are happy to help the Tax Office become more skilled around the industry by organising site visits which he believed would prove to be a benefit to all involved.

Michael Strong suggested that they could get the Excise Centre of Expertise to work with the Client Relationship Manager for the industry.

Darryl advised that there are some massive projects that is, Gorgon, port work, LNG plants. There are a number of projects in Queensland around coal seams and it would be great to have tax on board to ensure they are claiming their full entitlements.

Andrew advised Daryl that he would get in contact with him to see what we could organise.

Andrew advised that the next meeting was to be scheduled for mid-April 2010, however, if anything significant comes up that a special meeting would be called. Andrew reminded members that they can send any issues to the forum mail box.
