Settlement conditions and disclaimers

Each widely-based settlement is developed in accordance with the following guidelines:

Both the Privacy Act and secrecy provisions of the tax law protect the confidentiality of information we hold in relation to both settlement negotiations with you and the agreement itself.

We won't disclose the information to any person or organisation unless authorised by you.

For these reasons not all widely-based settlement agreements are able to be published. For example we won't publish settlement agreements in circumstances where the specific details of the settlement and/or the reasons for the settlement would enable the parties to be identified from the information published.

The settlement terms, factors considered and reasons for these terms can only be used as a general guide for the following reasons:

  • the terms published here are for the majority of participants in these arrangements. If you are not sure whether a particular settlement applies to you please contact us on 1800 177 006 for investment schemes or 1800 001 111 for employee benefit arrangement
  • each settlement is made at a point in time and reflects the particular circumstances at that time such as relevant legislation, case law and the circumstances of each party to the settlement
  • taxpayers who participated in an arrangement which had more than 20 participants (a widely-based arrangement) but believe they have unique individual circumstances may choose to apply to us for an individual settlement
  • taxpayers who participated in an arrangement not covered under any settlement arrangement mentioned here can still apply for an individual settlement under the Code of Settlement Practice
  • we have only provided details of the more significant settlement terms here. Most settlements will also include various terms as outlined in Chapter 10 of the Code of Settlement Practice, and
  • the settlement offer may have expired. Where possible, an indication of the status of the settlement offer is provided.

These settlement terms will not be offered to you if you have been referred for prosecution for criminal offences in relation to the arrangement.
