Marriage breakdown

  • For assets, or interests in assets, that were transferred or rights created (such as a right to use property) as a result of the breakdown of your legal or de facto marriage, did they happen because of:
    • an order of a court or a court order made by consent under the Family Law Act 1975 or a similar law of a foreign country?
    • a court order under a state, territory or foreign law relating to de facto marriage breakdowns?
    • binding financial agreement (or written agreement that is binding because of a State or Territory law relating to a de facto marriage breakdown)?
    • an arbitral award (or corresponding award relating to a de facto marriage breakdown)?
    • another arrangement?
  • Provide copies of the relevant order, agreement or award and information relating to the transfer or right created.
  • Describe and list the assets transferred.
  • The date each asset was transferred and the date of the CGT event under which it was transferred.
  • The date the asset(s) that were transferred were initially acquired by you or your former spouse (or the company or trust) and their cost.
