5. ATO Compliance program 2011-12

Brett Peterson, ATO provided a summary of the ATO's compliance program for 2011-12. Previously discussions with the SCC had focused on audit program of work, Brett provided information on the compliance program with a particular emphasis on communication activity.

Brett advised that communication program from the ATO is an important compliance tool, ensuring that individuals, their advisers and other participants in the system understand their entitlements and obligations.

Some particular aspects discussed include:

Co-contributions: only 10% of the eligible population make the necessary post-tax contribution. Following the reductions in co-contributions Brett advised that there has not been a large drop off in the number of participants.

eSAT tool: discussed that eSAT could be used for lower-level staff to educate themselves on auditor issues and be expanded as a training tool. Stuart Forsyth discussed that eSAT was not aimed at auditors who should know the substantive issues, but some changes have been made following the recent professional to professional pilot.

Illegal early release (IER): recognised by the forum as an area of success where compliance action has had a visible effect. Andrea Slattery asked about the ATO working with police on fraud matters. Stuart Forsyth advised that channels are in place to communicate with agencies if required. Following IER, Tony Keir, ASFA emphasised that the industry as a whole needs to be ready to spot the next development quickly and be ready to take action.

Superannuation guarantee: there was a discussion on the superannuation guarantee and the impact of the Medicare Clearing House. It was noted that the limit of 20 staff could be limiting access, particularly for employers with 20 full-time equivalent (FTE), but more than 20 individual staff members. The ATO's program of compliance with high risk industries was also discussed.
