Flood levy information for individuals

What is the flood levy?

The government has introduced a temporary flood and cyclone reconstruction levy (flood levy), which applies to taxable income for the 2011-12 financial year only.

The flood levy is designed to help affected communities recover from the recent natural disasters by providing additional funding to rebuild essential infrastructure - for example, roads, bridges and schools.

The flood levy applied to taxable income from 1 July 2011 to 30 June 2012. The flood levy will no longer apply to income derived on or after 1 July 2012.

Who has to pay the flood levy?

Individual taxpayers, whose taxable income was more than $50,000 in the 2011-12 financial year, have to pay the flood levy. This includes foreign residents who have Australian income.

Low income earners will not pay the flood levy
If you have a taxable income of $50,000 or less in the 2011-12 financial year, you will not be charged the flood levy.

Certain people affected by natural disasters will not pay the flood levy
Some people affected by natural disasters will be exempt from paying the flood levy, regardless of their taxable income.

Flood levy exemptions

A temporary one-year flood levy applies to your taxable income for the 2011-12 financial year unless you qualify for an exemption. You can use the information below to work out your levy or exemption.

How much is your levy?

The flood levy is an increase in tax on the part of your income above $50,000.

Are you exempt?

To qualify for an exemption from the flood levy, you must be able to answer 'yes' to at least one of the following exemption classes.

Class 1
Were you eligible for an Australian Government Disaster Recovery Payment for a natural disaster that occurred in the period 1 July 2010 to 30 June 2012 and did you receive this payment by 30 June 2012?

Class 2
In relation to a declared natural disaster that occurred during the period 1 July 2010 to 30 June 2012, did all of the following apply?

  • You were either at least 16 years of age or were receiving a social security payment from Centrelink.
  • You were an Australian resident for social security purposes at the time of the disaster.
  • One of the following conditions applied to you:

A

As a direct result of a declared natural disaster in the period 1 July 2010 to 30 June 2012 one of the following applied:

  • you were unable to gain access to your home for at least 24 hours
  • you were stranded in your home for at least 24 hours
  • your spouse, child, parent, brother, sister or legal guardian, who was an Australian citizen, died
  • you were seriously injured
  • your home was destroyed
  • your home sustained major damage.

B

As a result of the declared natural disaster your home was without electricity, or water, or gas, or sewerage service, or another essential service for at least 48 hours.

C

You were the principal carer of a dependent child under 16 years old who experienced any of the events listed in column A.

Class 3
Are you a New Zealand citizen who was eligible and received an ex-gratia payment from Centrelink for a natural disaster that occurred in the period 1 July 2010 to 30 June 2012?

Examples of class 2 exemptions

Example 1

    Lloyd lives in Cairns and earns $70,000 a year. Lloyd is over 16 years old and is an Australian resident for social security purposes. In March 2011, his home was surrounded by flood waters as a result of Cyclone Yasi. All roads leading out of Lloyd's property were blocked by flood water and Lloyd was stranded in his home for more than 24 hours.

    Lloyd did not receive an Australian Government Disaster Recovery Payment.

    Lloyd reads the exemption information and works out that, as he was stranded in his home for at least 24 hours, he meets one of the criteria and is exempt under class 2 from the flood levy.

Example 2

    Muhammad's home was directly in the path of Cyclone Yasi in February 2011. Muhammad is over 16 years old and is an Australian resident for social security purposes. The State Emergency Service (SES) required that his street be evacuated for the period of the cyclone. Residents were not allowed to return to their homes for 48 hours. Muhammad left his home and stayed at a friend's house, which was out of the area, for several days.

    Muhammad did not receive an Australian Government Disaster Recovery Payment.

    Muhammad reads the exemption information and works out that, as he was unable to gain access to his home for at least 24 hours, he meets one of the criteria and he is exempt under class 2 from the flood levy.

What do you have to do if you are exempt?

When you lodge your 2012 tax return, you need to confirm that you are exempt from paying the flood levy by completing the flood levy question.

We will not include the flood levy when we work out your tax payable.

This means that you may receive a larger tax refund, or have a lower amount payable, than would otherwise have been the case.

Example 3: Exempt from the flood levy

    Mark was affected by the Brisbane floods and received an Australian Government Disaster Recovery Payment from Centrelink. He knows he will be exempt from paying the levy in the 2011-12 financial year.

    When Mark completes his 2012 tax return, he declares that he was exempt from the flood levy by completing the flood levy question. We do not include the flood levy when working out Mark's tax payable.

How much will you pay

You will pay the flood levy unless you are:

  • exempt from paying the flood levy - to find out if you are exempt, complete the steps in Who is exempt from the flood levy?
  • a low income earner - if you have a taxable income of $50,000 or less in the 2011-12 financial year, you will not be charged the flood levy.

What type of income does the levy apply to?

The flood levy only applies to taxable income derived from 1 July 2011 to 30 June 2012. This means the levy will be applied to the income you include in your individual income tax return, such as salary and wages, investment income and business income.

The flood levy does not apply to exempt income

The levy will not apply to income which is exempt from income tax. For example, some super benefits paid to a person more than 60 years old.

The flood levy can apply to lump sum payments you may receive and some super benefits.

Exempt foreign employment income and the flood levy

The amount of tax you must pay when you earn exempt foreign employment income includes a component equivalent to the flood levy and the Medicare levy.

If you have foreign employment income that is exempt from Australian tax, the component equivalent to the flood levy and the Medicare levy is calculated based on an average tax rate on income that includes both your exempt foreign employment income and your taxable income.

Example 4

    In the 2011-12 income year, Sansa (who has appropriate private health cover) derives the following types of income:

    • Australian employment income of $40,300
    • exempt foreign employment income of $50,100.
    • She also has:
    • allowable deductions against Australian income of $300
    • expenses directly related to exempt foreign employment income of $100.

    While Sansa's taxable income is $40,000, and below the taxable income threshold at which the flood levy and the Medicare levy usually apply, Sansa must include the exempt foreign employment income to determine the total tax liability. She must pay an amount equivalent to the flood levy and the Medicare levy because her notional gross taxable income is $90,000.

    The total amount of Australian tax payable will be calculated using the following formula:

      (Notional gross tax / Notional gross taxable income) x Other taxable income

    Step 1

    Sansa's notional gross taxable income is

      ($40,300 - $300) + ($50,100 - $100)

      = $90,000

    Step 2

    The notional gross tax is $22,800 (the Australian income tax, Medicare levy and flood levy payable on a taxable income of $90,000).

    Step 3

    The other taxable income is $40,000 (Australian employment income).

    Step 4

    The Australian tax payable (including an amount for the flood levy and the Medicare levy) on Sansa's Australian income is:

      ($22,800 / $90,000) x $40,000 = $10,133.33

    The notice of assessment will show this tax liability as tax of $9,444.44, Medicare levy of $600 and flood levy of $88.89.

Government payments

The following payments are tax exempt and you do not need to include them in your tax return:

  • Australian Government Disaster Recovery Payment
  • ex-gratia payment from the Commonwealth known as 'Assistance for New Zealand non-protected special category visa holders' for
    • a disaster that occurred in Australia during the 2010-11 financial year
    • floods that occurred in Queensland and New South Wales in January, February and March 2012*.

Definitions

Australian Government Disaster Recovery Payment is a payment from Centrelink for people affected by natural disasters.

The Australian Government Disaster Recovery Payment is tax exempt and you do not need to include it in your tax return.

Natural Disaster Relief and Recovery Arrangements

The Australian Government provides funding through the Natural Disaster Relief and Recovery Arrangements to help pay for natural disaster relief and recovery costs.

This is a list of areas that received government funding under the Natural Disaster Relief and Recovery Arrangements.

Your principal place of residence is where you:

  • would normally reside
  • have a lawful right to reside.

Destroyed, for a place of residence, includes a residence damaged to the extent that it must be demolished.

Major damage, for a residence, means one of the following:

  • damage to at least a quarter of the interior of the residence
  • that the residence is structurally unsound
  • damage to the residence that exposes at least a quarter of the interior of the residence to the elements
  • sewerage contamination of the interior of the residence.

Seriously injured is where an individual was admitted to hospital because of the injury (or would have been admitted to hospital under normal circumstances).

Ex-gratia payment

The Centrelink ex-gratia payment is for people affected by natural disasters. The payment is tax exempt and you do not need to include it in your tax return.

Taxable income is the income you have to pay tax on. It is the term used for the amount left after you have deducted all the expenses you are allowed to claim from your assessable income. For more information, refer to What is taxable income?
