Super contributions from a first home saver account under a family law obligation

Part 1 - Former spouse of account holder to complete

Section A - Your details

Complete your details.

A super fund cannot accept a contribution from a first home saver account unless the fund has your tax file number. You must make sure your super fund has your tax file number.

Section B - Your super fund account details

The super fund account is the account that you want your share of the first home saver account contributed to.

Complete your super fund's name and address.

Provide your super fund's Australian business number (ABN) and your super fund account details.

Amount to be contributed

Your court order or binding financial agreement will show that the account holder is under an obligation to transfer an amount of money to you. Complete the amount that the account provider must transfer to your super fund account.

Section C - Account holder details

The account holder is the person whose name the first home saver account was opened in. For a family law obligation, the account holder will be your former spouse.

Complete the first home saver account holder's details in Section C. Some first home saver accounts don't have a BSB or account number. In this case you must provide the client identifier/reference number.

The account provider needs this information to make sure they withdraw the money from the correct first home saver account. As such, you must provide as many details as possible.

Section D - Your declaration and signature

Read the declaration then:

  • print your full name
  • print the name of your former spouse
  • sign and date the form.

Where you send the form

After completing this form:

  • give the form to the first home saver account provider
  • supply the account provider with evidence of the family law obligation, for example, court order or binding financial agreement.

Do not send a copy of the completed form to us at the Tax Office. Send it to the first home saver account provider.

The provider will use this form to make the contribution to your nominated super fund account.
