Non-Profit News Service No. 0285 - Recent case: Cooperative Bulk Handling Ltd

On 25 May 2010, Justice Gilmour handed down a decision in the case of Cooperative Bulk Handling Ltd v Commissioner of Taxation [2010] FCA 508. The case concerned the issue of whether Cooperative Bulk Handling Ltd (CBH) was exempt from liability to income tax on the basis that it is a society or association established for the purpose of promoting the development of Australian agricultural resources, and is not carried on for the profit or gain of its individual members. Justice Gilmour held that CBH was exempt from liability to income tax.

We are currently considering the implications of this decision. We will issue a further News Service item when the consequences of the decision have been considered.
