LMR provision of updated addresses program - Conditions of use

The ATO conducts its lost members register (LMR) provision of updated addresses program with participating superannuation providers who give lost members statements to the ATO. Under this program, the ATO supplies participating super providers with LMR data extracts containing updated address details for their relevant lost members, so they can contact those people and unite them with their super.

The ATO makes those LMR data extracts available to participating super providers through the ATO's bulk data exchange (BDE) facility - in each case by:

  • the ATO uploading the extract to the relevant super provider's dedicated BDE mailbox, and
  • that super provider's authorised user accessing that mailbox (through a user ID and password) and downloading that extract.

These LMR data extracts are made available under section 44 of the Superannuation (Unclaimed Money and Lost Members) Act 1999 and contain information included in the LMR pursuant to section 23(2)(b) of that Act.

These conditions of use

These conditions of use apply:

  • in connection with an LMR provision of updated addresses data extract made available to a participating super provider under the LMR provision of updated addresses program
  • from when that super provider's authorised user accesses that LMR data extract on or downloads it from the BDE facility
  • to that super provider (the provider) and that authorised user (the user).

These conditions of use are governed by the laws in force in the Australian Capital Territory.

Use of the BDE facility

Terms and conditions apply to the use of the BDE facility. The user must comply with (and the provider must ensure that the user complies with) those terms and conditions.

Use of the LMR data extract

The provider must only use the LMR data extract (or have that extract used on its behalf by a third-party service provider) for the purpose of:

  • matching that information to records in its database to ascertain updated addresses for its relevant lost members
  • using those updated addresses to contact those relevant lost members to ascertain whether those members' status should be changed from 'lost' to 'found' (and, where it ascertains that a member's status should be so changed, to update its database accordingly).

This does not limit the provider's legitimate use of information it has obtained from sources other than the ATO.

The LMR data extract contains lost member information initially provided by the provider to the ATO together with updated member address information (which the member may later provide to the provider - for example, by confirmation).

Destruction of the LMR data extract

The provider must ensure that all copies of the LMR data extract in its possession (or in possession of any of its third-party service providers) are promptly destroyed on the earlier of:

  • when the purposes for which the LMR data extract may be used have been exhausted
  • when the provider ceases to participate in the LMR provision of updated addresses program
  • when the ATO terminates its LMR program (by advising participating super providers).

Non compliance

If the user or the provider does not comply with these conditions of use, the ATO can revoke the user's status as an authorised user (and its BDE facility UserID and password), and the provider's participation in the LMR provision of updated addresses program.
