  • Penalties for non-compliance

When a supplier fails to notify, or notify correctly

Administrative penalties apply if you fail to provide the required notice to a purchaser. Penalties won't apply if you reasonably believed you were not required to meet the notice requirements.

An offence provision for failing to provide the required notice also applies (in the alternative). This is a strict liability offence. Penalties won't apply if you made an honest and reasonable mistake about how the notice requirements apply to a particular supply.
