    We collect data on purchases, sales and transfers of land and/or properties by foreign persons through the Land Register (formerly Agricultural Land Register). You must notify us if you:

    • have acquired an interest in agricultural land or are required to as a condition of your approval to purchase residential real estate
    • no longer have an interest in agricultural land
    • have changed foreign person status, either becoming a foreign person or ceasing to be a foreign person or have changed the land or property type from, or to, agricultural land or residential real estate.

    In what capacity are you submitting this registration?

    This question asks what your role is in completing this application on behalf of the applicant.

    Select the most appropriate option:

    • ‘An individual’ – if you are or were the owner of the land/property.
    • ‘A representative of a company, trustee or foreign government investor’ – for example, Director or Public Officer.
    • ‘An agent for an individual, company, trustee or foreign government investor’.

    If you select ‘An agent for an individual, company, trustee or foreign government investor’, then you must also select the ‘Agent type’ – for example, lawyer, solicitor, real estate agent.

    This is where your personal details are recorded, including your address, phone number, and email address. These details will be used to:

    • send information electronically to you in relation to this registration form, and
    • request clarification on information provided in this form.

    If you are completing this form as ‘An individual’, do not provide post office box details as your address.

    Reason for registration section

    What type of land or property are you registering?

    This question asks what type of land or property is being registered:

    • agricultural land, or
    • residential real estate.

    Reason for registration

    This field enables you to select one ‘Reason for registration’, from the following list:

    • transfer: buy
    • transfer: sell
    • change in status: to foreign person
    • change in status: from foreign person
    • change in status: to agricultural or residential real estate
    • change in status: from agricultural or residential real estate.

    If you have more than one reason for registration, a separate registration form is required for each reason.

    FIRB applications

    If you are registering the purchase, disposal or a change in status of residential real estate then you must enter your Foreign Investment Review BoardExternal Link (FIRB) application number (or numbers) relating to the property/land you are registering.

    A minimum of one FIRB application number is required for all residential real estate registrations.

    Ownership interest details section

    This section records the details of each entity (individual, foreign government investor, company or trustee) with an ownership interest in the land or property being registered.

    You need to ensure the name (or names) being registered as the owner (or owners) are the same as those which appear on the land title document (or documents). Information contained in the land title documents will also be required to complete the Land Details section below.

    You will need to declare the reason why the owner is considered a foreign person.

    Multiple entities

    You can register up to 20 different entities that have an ownership interest in the same property or land on this form.

    If there are more than 20 entities that have an ownership interest in the same property or land, please use a second registration form.

    A minimum of one entity must be provided for all agricultural land or residential real estate registrations.

    Land details section

    This section is for you to provide details about the property or land including location, type of property (residential) or land use (agricultural) and land title details.

    You can register up to 20 properties or land for entities with an ownership interest in the same property or land on this form. If there are more than 20 properties or land for entities with an ownership interest in the same property or land, read the Land Registration form instructions before continuing.

    Separate land details are required for each land or property interest to be updated on the register. For example, if the number of land or properties to be registered is two, you will need to complete the land details information twice (one for each land or property to be registered).

    Land or property type details

    The land or property type details provide information to identify the address of the property or land.

    The choice at the ‘State Territory’ field in this section of the form is used to determine what information you are required to complete in the land title details fields.

    The form will only display the land title details you need to complete based on the ‘State Territory’ you selected in the ‘Land or property type details’ field on this form.

    Land or property market value A$

    This is the value of the land that relates to the foreign interest.

    Example

    If the foreign person owns 50% of land, and the land is worth $1 million, then the land value would be $500,000.

    End of example

    Freehold interest

    The freehold interest is:

    • the sale price of the land if it was acquired or sold as part of an arm’s length transaction within the past 12 months, or
    • the value of the land calculated on a reasonable basis having regard to the market value of the land (including buildings or other structures on the land).

    Leasehold interest

    The lease value is the total value of the lease over the term of the lease.

    The following amounts should be included in the value of the lease:

    • up-front initial payments (other than taxes and regulatory charges) for the grant of the leasehold interest
    • annual lease payments including amounts as increased in accordance with a formula over the term of the lease
    • amounts likely to be paid for an extension or renewal of the lease (if prescribed under the lease agreement).

    Land use details

    Land use details are only displayed where the type of property being registered is agricultural land.

    The total percentage of land use details must equal 100%.
