  • New advice and guidance product: SMSF Regulator's Bulletin

We have created a new public advice and guidance product specifically for self-managed super fund (SMSF) trustees and their advisors, called an SMSF Regulator's Bulletin (SMSFRB). This product will provide targeted and timely updates about new, or emerging, superannuation regulatory and income tax arrangements that pose potential compliance risks for the SMSF sector.

When a new SMSFRB is available, we will let you know via our SMSF news channels.

We will publish the bulletins on our Legal Database. You can subscribe to the database to be notified when new or updated information is published.

Our first SMSF Regulator's Bulletin – SMSFRB 2018/1: The use of reserves by SMSFs

Our first SMSFRB, about the use of reserves by SMSFs, is now available. SMSFRB 2018/1 confirms that we expect the use of reserves by SMSFs to only occur in limited circumstances. It also outlines our concern that reserves may be used to circumvent restrictions imposed in the superannuation and income tax legislation introduced by the Government’s 2016 Budget super changes.

Read SMSFRB 2018/1 to find out about:

    • what we consider to be a reserve for both superannuation and income tax purposes
    • the circumstances where the use of a reserve may be considered to be outside legitimate circumstances
    • our compliance approach.
