  • If you don’t lodge your SMSF annual return on time...

Lodging your self-managed super fund (SMSF) annual return on time is a critical part of your legal responsibilities as an SMSF trustee. Where SMSFs have one or more years of overdue lodgment we will remove them from Super Fund Lookup (SFLU) and apply failure to lodge on time penalties.

Over the past year, we've written to over 50,000 SMSF trustees advising them their lodgment is overdue and we've removed them from SFLU. We've warned these funds our next step will be to impose failure to lodge penalties. We also advised these funds to consider whether they want to continue operating their SMSF and if not, we directed them to guidance regarding what they need to do to wind up their SMSF and avoid future lodgment, reporting and auditing responsibilities.

We've also reminded super funds and employers they shouldn’t roll over benefits or pay super guarantee to funds that aren’t on SFLU.
