SECTION 45   CREDITOR ' S PETITION AGAINST PARTNERSHIP  

45(1)   [Partnership debt]  

A creditor of a partnership may present a petition against the partnership if he or she is entitled to present a petition against any one of the members of the partnership in respect of a partnership debt.

45(2)   [May be against any member]  

A creditor who is entitled to present a petition against a partnership may present a petition against any of the members of the partnership without including the others.
