Part 11 - Access to premises  

48   Identity cards  

(1)    
The Commissioner must issue an identity card to a person who is an authorised officer for the purposes of section 47.

(2)    
The identity card must be in the form prescribed by the regulations.

(3)    
The identity card must contain a recent photograph of the authorised officer.

(4)    
A person is guilty of an offence if:


(a) the person has been issued with an identity card under subsection (1); and


(b) the person ceases to be an authorised officer for the purposes of section 47; and


(c) the person does not immediately return the identity card to the Commissioner.

Penalty: 1 penalty unit.

Note:

Chapter 2 of the Criminal Code sets out the general principles of criminal responsibility.


(5)    
A person who is an authorised officer for the purposes of section 47 must carry the identity card at all times when exercising the powers or performing the functions of such an authorised officer.
