PART 10.25 - TRANSITIONAL PROVISIONS RELATING TO THE INSOLVENCY PRACTICE SCHEDULE (CORPORATIONS)  

Division 4 - Administrative review  

SECTION 1621   ADMINISTRATIVE APPEALS TRIBUNAL PROCEEDINGS  

1621(1)    
This section applies if an application is made to the Administrative Appeals Tribunal for review of a decision made under the old Act either:


(a) before the commencement day; or


(b) on or after the commencement day (in accordance with a provision of this Part).

1621(2)    
Subject to this Part, nothing in the Insolvency Law Reform Act 2016 affects:


(a) any proceedings before the Administrative Appeals Tribunal in relation to the decision; or


(b) the powers of the Administrative Appeals Tribunal in relation to the decision; or


(c) any enforcement in relation to, or as a result of, a decision of the Administrative Appeals Tribunal in relation to the decision; or


(d) any appeal or review in relation to a decision of the Administrative Appeals Tribunal in relation to the decision.

1621(3)    
Subject to this Part, the old Act continues to apply on and after the commencement day in relation to the proceedings despite the amendments and repeals made by Schedule 2 to the Insolvency Law Reform Act 2016 .

Applications for review made after the commencement day

1621(4)    
Despite the repeals and amendments made by the Insolvency Law Reform Act 2016 , applications may be made to the Administrative Appeals Tribunal for review of the decision.
