SECTION 769C   REPRESENTATIONS ABOUT FUTURE MATTERS TAKEN TO BE MISLEADING IF MADE WITHOUT REASONABLE GROUNDS  

769C(1)   [ Representation with respect to future matter]  

For the purposes of this Chapter, or of a proceeding under this Chapter, if:


(a) a person makes a representation with respect to any future matter (including the doing of, or refusing to do, any act); and


(b) the person does not have reasonable grounds for making the representation;

the representation is taken to be misleading.

769C(2)   [ Limitation]  

Subsection (1) does not limit the circumstances in which a representation may be misleading.

769C(3)   [ ``proceeding under this Chapter'']  

In this section:

proceeding under this Chapter
has the same meaning as it has in section 769B .
