SUMMONS
A bank sought a declaration that the payment by it of $13,237.71 pursuant to cheques drawn by a company in liquidation, between the date when the petition for winding up was presented and the date when the account was closed, was not a disposition of the property of the company within s. 227 (1) of the Companies Act, 1961.


I make declaration 1 (a) as asked; the respondent liquidator is to pay the costs of the bank to date; I reserve further consideration of the other matters raised in the summons and I reserve further costs.

Order accordingly.
