For the reasons given by the Chief Justice and Deane J., I agree that, whatever questions may be raised by the context of the Motor Vehicles Act 1959 (SA), there is nothing which is sufficiently compelling to require a departure from the plain meaning of the words used in s 133. Accordingly, I am of the view that that section did apply to the contract for the carriage of the goods and that the appeal should be dismissed.
