I agree with the judgment of Priestley J.A., which I have had the advantage of reading. The appellants accepted the findings of fact made by Rath J. and the appeal was argued upon that basis. In saying this, I do not suggest that the appellants could have done otherwise. But, given those findings, it is, in my opinion, inevitable that the appeal be dismissed. I agree with the order proposed by Priestley J.A.
