SECTION 853 QUALIFIED PRIVILEGE FOR ADVISER WHEN COMPLYING WITH THIS DIVISION 853 A securities adviser who: (a) makes a securities recommendation in relation to securities to a person who may reasonably be expected to rely on it; and (b) in so making the recommendation, contravenes neither of subsections 849(2) and 851(1); has qualified privilege in respect of a statement the securities adviser makes to the person, whether orally or in writing, in the course of, or in connection with, so making the recommendation.
