CCH note - modifying legislative instruments: The application of Ch 6D is affected by the following legislative instruments that commenced or were amended on or after 1 January 2022: the ASIC Corporations (Employee Incentive Schemes - Ongoing Relief) Instrument 2025/169; and the ASIC Corporations (Offers of CHESS Depository Interests) Instrument 2025/180.
For legislative instruments or class orders before 1 January 2022 that affect the application of Ch 6D, please consult the legislative instruments or class orders directly. These are reproduced in the regulatory-resources section of the company-law practice area in CCH iKnowConnect.
Subject to subsections (2) and (3), the following provisions of Chapter 7 (the applied provisions ) have effect for the purposes of this Part as if references in the provisions to that Chapter were instead references to this Part:
(a) section 761F (meaning of person - generally includes a partnership);
(b) section 761FA (meaning of person - generally includes multiple trustees);
(c) section 769B (people are generally responsible for the conduct of agents, employees etc.).

Subsection (1) does not apply to provisions of the sections mentioned in subsection (1) that are expressed to relate only to specific provisions of Chapter 7 or to specific Parts, Divisions or Subdivisions of Chapter 7.

The regulations may provide that one or more of the applied provisions have effect for specified purposes subject to modifications specified in the regulations. The regulations have effect accordingly.
