197   Paragraph 36(1)(a)

Repeal the paragraph, substitute:

(a) a provision of the governing rules (within the meaning of the Australian Charities and Not-for-profits Commission Act 2012) of a registered charity (whether made before or after the commencement of this Act), if the provision:

(i) confers charitable benefits; or

(ii) enables charitable benefits to be conferred;

on persons of a class identified by reference to any one or more of the grounds of discrimination referred to in this Act; or
