SECTION 365 APRA TO APPOINT NEW TRUSTEE
365(1)
Subject to subsections (2) and (3), if APRA receives a notice under section
363
, APRA must appoint a constitutional corporation as the new trustee of the Part
31
entity.
365(2)
If APRA also receives a notice under subsection
364(2)
, APRA must not appoint the existing management company as the new trustee.
365(3)
If APRA also receives a notice under subsection
364(3)
, APRA must appoint the existing management company as the new trustee.
365(4)
The appointment of the new trustee does not take effect except as provided in section
366
.
