Use this form if you've received a letter about a capital gain or capital loss associated with the sale of crypto assets.

When to use the form

Use this form to:

  • let us know why a capital gain or loss was not included in your tax return, or
  • confirm that the amount reported is correct, including details of how the capital gain or loss was calculated.

What you will need

To complete this form, you will need the following information:

  • date the crypto was purchased and the purchase price
  • date the crypto was sold and the sale price
  • date you reported the sale to us (if applicable)
  • how you have calculated the CGT (if applicable)
  • details of any CGT exemption applied.

Due date to submit this form

You must submit the form electronically by the date specified in your letter.

How to submit the form

Once you have completed your answers:

  1. Save the file to your device as CGTCD.xls or CGTCD.xlsx. This will ensure you have a copy for your personal records.
  2. Send a copy of the completed form via email attachment to CGTCrypto@ato.gov.au. Include the unique identifier from your letter in the email. You don't need to give your personal details.

If you choose to communicate with the ATO via email, be aware that the internet is not a secure environment and we cannot guarantee the privacy and security of personal information.

What happens if you don't respond

If you choose not to respond, we may:

  • take further compliance action, such as an audit, which could result in additional costs to you
  • estimate your net assessable amount or taxable income.

If we find you owe us tax, we will apply a penalty of at least 75% on that amount. This means an extra $750 for every $1,000 you owe.
