Cancellation of a lodged Auditor Contravention Report

Learn when and how to cancel an Auditor Contravention Report due to a genuine reporting error.

As an SMSF auditor, you must notify the ATO if a reportable contravention of the superannuation law has occurred, is occurring or may occur. You do this by lodging an Auditor Contravention Report (ACR) within 28 days of completing the audit.

You can cancel a lodged ACR if you made a genuine error. If your reason doesn't meet the criteria, we will decline your request. Genuine errors include:

  • lodging under the wrong fund ABN
  • providing incorrect information about the contravention based on the evidence you had in your possession at the time of reporting the contravention to us.

If you receive new information after lodging the report that shows the reported contravention was incorrect, didn't occur, or has been rectified, you should lodge a revised ACR. We treat the original contravention as correct at the time of lodgment.

We prefer you using Online services for business to request a cancellation. If you provide all necessary information and valid reasons for cancellation, we will respond to your request within 28 days.
