Order

Appeal allowed. Order of the Supreme Court of South Australia varied by deleting the answers to questions 1(a) and 1(f) and by substituting therefor the following answers:

1(a). That pursuant to the will of Norman Harold McBride, his widow, Hilda McBride, became entitled to receive 1,960 shares of £1 each in the capital of Elder Smith & Co Ltd;
1(f). That no exception can be taken to the form of accounting employed by the trustees for the purpose of ascertaining the net profits of each year prior to the death of the said Hilda McBride.

Costs of all parties to the appeal to be paid out of the residuary estate of the testator.
