SECTION 54P   IC review applications - requirement to notify affected third parties  


Scope

54P(1)    
This section applies if:


(a) an agency or Minister decides not to give access to a document to which a consultation requirement applies under section 26A , 27 or 27A ; and


(b) an IC review application is made for an IC review of that decision.



Requirement to notify

54P(2)    
The agency or Minister must, as soon as practicable, take all reasonable steps to notify the affected third party for the document of the application.

Note 1:

For affected third party , see section 53C .

Note 2:

The agency or Minister is not required to give notice if the Information Commissioner orders that it is not appropriate to do so in the circumstances (see section 54Q ).


54P(3)    
The agency or Minister must, as soon as practicable, give a copy of the notice to the Information Commissioner.
