SECTION 852A   ACQUISITION OF PROPERTY  

852A(1)   [ Unjust acquisition of property]  

The Court must not make an order under section 850D if:


(a) the order would result in the acquisition of property from a person otherwise than on just terms; and


(b) the order would be invalid because of paragraph 51 (xxxi) of the Constitution.

852A(2)   [ Limitation]  

Section 1350 does not apply in relation to the making of an order under section 850D .

852A(3)   [ Definitions]  

In this section:

acquisition of property
has the same meaning as in paragraph 51 (xxxi) of the Constitution.

just terms
has the same meaning as in paragraph 51 (xxxi) of the Constitution.
