VET FEE-HELP Assistance Scheme
The *Secretary may, in writing, delegate his or her powers and functions that: (a) arise under the *Regulatory Powers Act as the relevant chief executive; and (b) relate to this Division;
The *National VET Regulator may, in writing, delegate his or her powers and functions that: (a) arise under the *Regulatory Powers Act as the relevant chief executive and relate to this Division; or (b) arise under clause 39GA of this Schedule;
A person exercising powers or performing functions under a delegation under subclause (1) or (2) must comply with any directions of the delegator. 39GC(4)
A person must not exercise powers or perform functions under a delegation under subclause (1) or (2) in relation to an infringement notice given by the person.

SECTION 39GC
Delegation by relevant chief executive etc.
39GC(1)
The *Secretary may, in writing, delegate his or her powers and functions that: (a) arise under the *Regulatory Powers Act as the relevant chief executive; and (b) relate to this Division;
to an SES employee, or an acting SES employee, in the Department.
39GC(2)The *National VET Regulator may, in writing, delegate his or her powers and functions that: (a) arise under the *Regulatory Powers Act as the relevant chief executive and relate to this Division; or (b) arise under clause 39GA of this Schedule;
to an *NVETR staff member who is:
(c) an SES employee or an acting SES employee; or (d) an APS employee who holds or performs the duties of an Executive Level 2 position or an equivalent position.
39GC(3)
A person exercising powers or performing functions under a delegation under subclause (1) or (2) must comply with any directions of the delegator. 39GC(4)
A person must not exercise powers or perform functions under a delegation under subclause (1) or (2) in relation to an infringement notice given by the person.
