SECTION 87
TRIBUNAL MAY REFER TO DISPUTE RESOLUTION PROCESS
General rules
87(1)
At any time during a proceeding, the Tribunal may, by order: (a) direct that the proceeding, or any part of or matter arising out of the proceeding, be referred to a dispute resolution process; and (b) direct any of the following persons to conduct the dispute resolution process:

The parties to the proceeding appearing at the dispute resolution process must act in good faith in relation to the conduct of the dispute resolution process.
Exception - guidance and appeals panel proceedings
87(3)
Despite subsection (1) , the Tribunal must not direct that a guidance and appeals panel proceeding, or any part of or matter arising out of a guidance and appeals panel proceeding, be referred to a dispute resolution process other than conferencing.

87(1)
At any time during a proceeding, the Tribunal may, by order: (a) direct that the proceeding, or any part of or matter arising out of the proceeding, be referred to a dispute resolution process; and (b) direct any of the following persons to conduct the dispute resolution process:
(i) a member;
(ii) a registrar;
(iii) a person engaged under subsection 90(1) .
Note:
A non-participating party to the proceeding or a Tribunal case event of that kind is not required to appear at the dispute resolution process unless the Tribunal orders the party to do so under section 63 .
87(2)
The parties to the proceeding appearing at the dispute resolution process must act in good faith in relation to the conduct of the dispute resolution process.
