I have had the advantage of perusing the draft reasons prepared by each of my colleagues. I agree with the conclusion reached by Mr McCarthy and I adopt his findings of fact and reasons for the conclusion he has reached. In the circumstances it is unnecessary to express any opinion on the matter of interpretation upon which Mr Roach has based his decision.
