Customs Amendment (Anti-dumping Commission) Bill 2013

Explanatory Memorandum

(Circulated by authority of the Minister for Home Affairs, the Honourable Jason Clare MP)

General outline

1. The purpose of this Bill is to amend the Customs Act 1901 (the Act) to establish the Anti-Dumping Commission.

2. The Anti-Dumping Commission will be established within the Australian Customs and Border Protection Service and will consist of:

the Commissioner, and
staff assisting the Commissioner made available by the CEO of Customs.

3. The Commissioner will be given the existing powers and functions of the CEO which relate to anti-dumping matters contained in Part XVB of the Customs Act 1901.

4. The amendments in this Bill will deal with the establishment of the Commission and the appointment of the Commissioner.
