Explanatory Memorandum

Amendments to be moved on behalf of the Government

Amendment (1)

1. Amendment (1) inserts a definition of "substantial adverse effect" into proposed section 15YV of the Crimes Act 1914. It will be defined as an effect that is adverse and not insubstantial, insignificant or trivial, and is the same definition that is used in the National Security Information (Criminal Proceedings) Act 2004.

2. Amendment (2) inserts a definition of "substantial adverse effect" into proposed section 25A of the Foreign Evidence Act 1994. It will be defined as an effect that is adverse and not insubstantial, insignificant or trivial, and is the same definition that is used in the National Security Information (Criminal Proceedings) Act 2004.
