Student Assistance Act 1973

Legislative Instrument

I, Julie Collins, acting Minister for Social Services, make the following Determination.

1 Name

This instrument is the Student Assistance (Education Institutions and Courses) Amendment (Tertiary Course Requirements and Masters by Coursework) Determination 2024.

2 Commencement

(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

(2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3 Authority

This instrument is made under subsection 5D(1) of the Student Assistance Act 1973.

4 Schedules

The instrument that is specified in Schedule 1 to this instrument is amended as set out in the applicable items in Schedule 1, and any other item in Schedule 1 to this instrument has effect according to its terms.

Schedule 1 – Amendments

Student Assistance (Education Institutions and Courses) Determination 2019

Part 1 – Tertiary course requirements

1 Subsection 11(1)

Omit "full-time".

2 Subsection 11(2)

Repeal the subsection.

3 Subsection 11(3)

Omit "or (2)".

4 Schedule 2 (subheading)

Omit "subsections 11(2) and 12(1)", substitute "subsection 12(1)".

5 Schedule 2 (table – Item 6)

After paragraph (h), insert:

(ha)

a course that:

(i)

includes a course accredited at Masters level and specified in Schedule 3; and

(ii)

includes a course that leads to one of the qualifications in paragraphs (a) to (g) above; and

(iii)

is identified as a combined course in the institution's handbooks; and

(iv)

does not include a course accredited at Doctorate level; or

6 Schedule 2 (table – Item 9)

At the end of paragraph (h), insert:

; or

(i)

a course that:

(i)

includes a course accredited at Masters level and specified in Schedule 3; and

(ii)

includes a course that leads to one of the qualifications in paragraphs (a) to (g) above; and

(iii)

is identified as a combined course in the institution's handbooks; and

(iv)

does not include a course accredited at Doctorate level

7 Schedule 3 (subheading)

Omit "subsections 11(2) and 12(2)", substitute "subsection 12(2)".
