SECTION 105 CALCULATION OF TIME 105(1) [Particular days or events to be excluded from calculation] Where, for any purpose, this Law: (a) prohibits, permits or requires the doing of an act or thing within, or by or before the end of; or (b) otherwise prescribes, allows or provides for; a period or time before or after a particular day, act or event, the period shall be calculated without counting that day, or the day of that act or event, as the case may be. 105(2) [Period between days and events] Without limiting the generality of subsection (1), in calculating how many days a particular day, act or event is before or after another day, act or event, the first-mentioned day, or the day of the first-mentioned act or event, shall be counted but not the other day, or the day of the other act or event. 105(3) [Day not a business day] Where the last day of any period prescribed or allowed by this Law for the doing of anything falls on a day that is not a business day in the place in which the thing is to be or may be done, the thing may be done on the first day following which is a business day in that place.This information is provided by CCH Australia Limited Link opens in new window.
