Division 323 - Disclosure of information  

SECTION 323-10   AUTHORISED DISCLOSURE: SHARING INFORMATION ABOUT INSURERS AMONG AGENCIES  

323-10(1)    
This section applies to information if the information:

(a)    relates to any or all of the following:


(i) a private health insurer;

(ii) an applicant to become a private health insurer;

(iii) a person carrying on [*]

health insurance business;

(iv) a [*]

To find definitions of asterisked terms, see the Dictionary in Schedule 1 .

director or [*]

To find definitions of asterisked terms, see the Dictionary in Schedule 1 .

officer of a person mentioned in subparagraph (i), (ii) or (iii); and

(b)    is not information of a kind specified in the Private Health Insurance (Information Disclosure) Rules as information that must not be disclosed under this section.


323-10(1A)    
For the purposes of subsection 323-1(3) , a person to whom subsection (2) applies may disclose the information to:

(a)    another person to whom subsection (2) applies; or

(b)    the Private Health Insurance Ombudsman; or

(c)    an APS employee in, or a person holding or performing the duties of an office in, the Statutory Agency of the Commonwealth Ombudsman; or

(d)    [*]

APRA; or

(e)    an APRA member or APRA staff member (within the meaning of the Australian Prudential Regulation Authority Act 1998 );

if the disclosure is made in accordance with any requirements in the Private Health Insurance (Information Disclosure) Rules.


323-10(2)    
This subsection applies to the following persons:

(a)    the Minister;

(b)    the Secretary of the Department;

(c)    an APS employee in, or a person holding or performing the duties of an office in, the Department;


(d) - (e) (Repealed by No 87 of 2015)


(f) - (g) (Repealed by No 57 of 2015)

(h)    the Chief Executive Medicare;

(i)    a Departmental employee (within the meaning of the Human Services (Medicare) Act 1973 ).
