CHAPTER 12 - FINANCIAL SECTOR REFORM  

PART 12.4 - NOTICE OF MEETINGS OF CERTAIN BODIES CORPORATE  

REGULATION 12.4.04   NOTICE OF MEETINGS TO BE PUBLISHED  

12.4.04(1)    
If the body corporate gives notice under subregulation 12.4.03(1) , notice of a meeting of the body corporate must be given in accordance with this regulation.

12.4.04(2)    


The notice must be published, at least 21 days before the day on which the meeting is to be held:

(a)    unless paragraph (b) applies - in a manner that results in the notice being accessible to the public and reasonably prominent; or

(b)    if a determination under subregulation (4) is in force - in a manner specified in the determination.


12.4.04(3)    
The notice must:

(a)    set out the date and time when, and the place where, the meeting is to be held; and

(b)    state the general nature of the business proposed for the meeting; and

(c)    include a statement to the effect that a member of the body corporate who is entitled to vote at the meeting may request the body corporate to give the member personal notice of the meeting; and

(d)    set out information about how a member may request the body corporate to give the member personal notice of the meeting.

Reg 12.4.04(4)    


For the purposes of paragraph (2)(b) , ASIC may, by legislative instrument, make a determination specifying one or more manners in which a notice under this regulation may be published.

Reg 12.4.04(5)    


A manner of publication may be specified in the determination only if ASIC considers that the manner of publication would result in such a notice being accessible to the public and reasonably prominent.
