CHAPTER 5 - THE SECURITY OF THE COMMONWEALTH Part 5.3A - State sponsors of terrorismA person commits an offence if: (a) the person intentionally is a member of a foreign state entity; and (b) the entity is a state sponsor of terrorism; and (c) the person knows the entity is a state sponsor of terrorism.
Note:
For defences, see subsection (2) and section 112.8 .
Penalty: Imprisonment for 10 years.
Exception
(2)
Subsection (1) does not apply if the person proves that the person took all reasonable steps to cease to be a member of the entity as soon as practicable after the person knew that the entity was a state sponsor of terrorism.
Note:
A defendant bears a legal burden in relation to the matter in subsection (2) (see section 13.4 ).
