Subdivision 40-C - Notice and effect of suspension under Subdivision 40-A  

SECTION 40-40   Lifting a suspension under Subdivision 40-A  

40-40(1)    
If your registration has been suspended under Subdivision 40-A , you may apply to the Board for the suspension to be lifted.

40-40(2)    
An application under subsection (1) must:

(a)    state that the action mentioned in paragraph 40-30(1)(b) has been taken; and

(b)    be accompanied by evidence of the action having been taken; and

(c)    be accompanied by any documents that are required by the Board.

40-40(3)    
The Board must lift a suspension of registration if satisfied that the action mentioned in paragraph 40-30(1)(b) has been taken.

40-40(4)    
If the Board lifts a suspension of registration, the Board must, within 30 days of the decision to lift the suspension, notify you in writing of the decision.

40-40(5)    
The lifting of a suspension takes effect on the day after the day on which notice under subsection (4) is given.

40-40(6)    
The Board must also notify the Commissioner of the Board ' s decision to lift a suspension, the reasons for it and the actions that were taken to lift it.
