Ruling

Subject: Commissioner's discretion for an extension to the two year period for main residence exemption of a deceased estate

Question

Will the Commissioner allow an extension of time for you to dispose of your ownership interest in the dwelling and disregard the capital gain you make on the disposal?

Answer

Yes.

Having considered your circumstances and the relevant factors, the Commissioner will allow an extension of time. Further information about this discretion can be found by searching 'QC 52250' on ato.gov.au

This ruling applies for the following period:

Year ended 30 June 2020

The scheme commences on:

1 July 2019

Relevant facts and circumstances

An individual passed away.

The property was the deceased's principal place of residence.

The deceased acquired a 50% interest in the property before 20 September 1985 and the remaining 50% interest was acquired after 20 September 1985.

The property has been vacant since the date of death.

Probate was granted.

The property was listed for sale and remained on the market with the price being adjusted to facilitate sale and settlement.
