This Ruling considers the sales tax classification of liquid organic crystalline polymer.
2. Sub-item 85A(1) in the First Schedule to the Sales Tax (Exemptions and Classifications) Act exempts from sales tax paints and other coatings in liquid, paste or powder form of a kind marketed exclusively, or primarily and principally, for application to buildings or other fixtures.
FACTS
3. Liquid organic crystalline polymer is a substance applied to the surface of buildings, bridges and other public construction projects. It can be applied to walls and concrete surfaces, marble floors and wood. The colourless liquid penetrates the building materials up to 8mm deep (depending on surface porosity) and is allowed to act for 2-3 minutes before the surplus is wiped off. The solution does not change the surfaces or values of buildings. Building surfaces treated with the substance are effective against vandalism and spray-paint graffiti can be removed with a pressure cleaner. They impede corrosion, repel water, dirt, glues and soiling by paints. It is effective against most fungi and algae-infected areas.
RULING
4. Liquid organic crystalline polymer is a liquid coating of a kind marketed exclusively, or primarily and principally, for application to buildings or other fixtures and is exempt under item 85A(1) in the First Schedule to the Sales Tax (Exemptions and Classifications) Act.
